Abuse of power by state actors and the need for equal protection and due process under the law:

What is it?

We depend on law enforcement and government workers to help us in times of need.  Every person deserves fair and reasonable treatment by state actors.  Constitutional violations can occur however, when state actors abuse power illegally or discriminate.  These abuses create a lack of trust in our officials and real harm to our democratic society.

Examples of state actors.

You may sue state actors and the government when they violate your civil rights.  Examples of state actors include, but are not limited to:
    • Counties
    • Boroughs
    • Townships
    • School Districts
    • County Agencies, e.g. Children & Youth, Welfare Office
    • Police and Sheriff Departments

What is the consequence?

Civil rights violations are prohibited under the United States Constitution and state and federal law.

Under federal law, a victim of a civil rights violation may seek:

    • An injunction (a court order designed to stop the civil rights violation)
    • Money for the injuries caused by the state actor
    • Punitive damages (relief designed to punish the state actor for the abuses)
    • Attorney fees (state actors pay when you prevail)
