What is an Appeal?

You may have been unsuccessful in a case in front of an administrative agency or a court.  A party who disagrees with the result may try to change it or try to obtain a new trial by having the case reviewed by a higher court.  In cases that raise issues with merit, you may be able to take an “appeal” or ask that another court or body hear your case.  Your opponent may also file an appeal of a result that has been favorable to you.  These appeals may occur from an administrative agency decision, at the state court level and at the federal level.

If you are contemplating an appeal, it is important to consult with an attorney as soon as possible to ensure that you do not miss a deadline.  An appeal generally begins with a Notice of Appeal.  This is a relatively simple document, but it must be filed within set time limits or you may lose your right to appeal.
